The possible violation of the partner's rights in legitimate succession

There is a disparity in inheritance rights between the surviving spouse and the surviving partner in legitimate succession. There is discriminatory treatment with regard to the inheritance rights of partners, not only in the letter of civil law, but also in the position adopted by the higher courts, albeit not unanimously, which clearly violates the rights of partners, since they compete for the inheritance of the deceased even with collateral relatives; they are not part of the order of inheritance and do not appear as necessary heirs of the author of the inheritance.
