Native Marijuana: American Indian Sovereignty v. Federal Drug Policy

The cannabis industry presents vast economic potential to the Native Tribes of North America, the States, and the nation at large, with the overlapping sovereignty of American Indian Tribes, the States they are situated in, and the Federal Government bringing rise to unprecedented questions of Constitutional law and sovereign power. The progress realized and difficulties faced by tribes in support of the cannabis industry, including the Squaxin Island Tribe of Washington, are presented and analyzed, alongside the efforts undertaken by tribes against marijuana industrialization including the Pit River Tribe of California. As with the States, the unresolved Federal question clouds the future of cannabis in Indian Country.
