A historical revisit of the Fine Penalty

This article searches historical structures for foundations that constitute sufficient apparatus to support the legitimacy of the Fine Penalty institute in a legal order that claims to be based on the paradigm of the Democratic Rule of Law. The purpose of the historical revisit is to understand the past, in search of the foundations of the legitimacy of the penalty as an alternative to deprivation of liberty, and the dogmatic aspects are of fundamental importance today.
