Evidence and Proof in the Scottish Legal Process
This book will be the first book in Scotland to combine analysis of the law of evidence with discussion of the various contexts and factors which affect the way evidence is handled in law. The authors will argue that legal education needs to take facts seriously and that the picture of evidence gained by looking at statutes and decisions of appeal courts, which focus mainly on rules excluding evidence from court, is grossly misleading, Evidence and proof must, instead, be understood as involving a variety of contexts and processes going well beyond the courts.
